O presente artigo parte da problemática: qual a forma de repressão estatal brasileira relativa às fake news? Como provável hipótese de pesquisa tem-se que o Estado brasileiro não tem sido eficiente em dirimir este problema, carecendo de regulamentação específica. O objetivo geral consiste em analisar a atuação do Estado em relação à contenção de fake news. Para tanto, utilizou-se o método de procedimento dedutivo e o de pesquisa bibliográfico. Como conclusão, percebe-se que o Estado brasileiro não consegue alcançar o (...) fenômeno das fake news e a repressão acaba ficando a cargo da iniciativa privada. (shrink)

Vir a ser cidadão: Educação, Política e Psicologia do Desenvolvimento Resumo: Considerando a tese honnethiana de que, hodiernamente, há um desenlace entre Educação e Política, e afirmando um forte nexo entre essas áreas no pensamento de Jean-Jacques Rousseau, neste trabalho, apresentamos alguns aspectos de como, para este, é possível que o ser humano, como membro da espécie, venha a ser cidadão. Em seguida, contando com a crítica de Nussbaum sobre como muitas propostas educacionais não explicitam uma psicologia do desenvolvimento, (...) aventamos uma vinculação entre Educação, Política e ideias psicológicas em Rousseau. Adiante, trazemos elementos da pesquisa psicogenética de Jean Piaget, propondo que esse tipo de pesquisa permite um fortalecimento do nexo entre as áreas da Educação, Política e, agora, Psicologia do Desenvolvimento, contribuindo para a discussão ainda atual acerca do vir a ser cidadão. Then, relying on Nussbaum's critique of the fact that many educational proposals do not make developmental psychology explicit, we suggest a link between Education, Politics and psychological ideas in Rousseau. Este trabalho, apresentado em forma de ensaio filosófico e pedagógico, propõe experimentar modos outros de escrever e interpretar os conceitos de Michel Foucault. Para desenvolver a analítica, parte-se de três conceitos basilares: saber, poder e subjetividade. A tese que se instaura é que a interpretação se dá na articulação entre movimentos recíprocos de interioridade e exterioridade do sujeito –constituído pelos discursos, pelos jogos de poder e pelas tecnologias de si – que, para significar o mundo, dá nomes e, (...) assim, sentido para a existência. Como resultado, o trabalho propõe pensar a hermenêutica foucaultiana como transgressora, não pelo seu caráter subversivo, mas pela possibilidade de funcionar como ferramenta teórica e metodológica. Interpretar é, nessa perspectiva, projetar o espaço-outro, o tempo-outro e a vida-outra, indagando o impacto da crise anti-intelectualista e negacionista. (shrink)

Il multiculturalismo è un modello culturale e politico-istituzionale per la gestione della diversità in una società multietnica, la cui base teorica viene dal relativismo culturale. Come nessuna cultura può pretendere una validità universale, il processo di storicizzazione della razionalità occidentale segna la fine della pretesa metafisica di dire la verità dell’uomo e del mondo, nononstante si crede che il fare della scienza è l’accadere della verità. Nel gestire la diversità e nell’assicurare la tolleranza risiede la «necessità» del multiculturalismo. Sua debolezza (...) teorica risiede paradossalmente nell’incapacità di pensare la differenza. Universale non è la cultura, che è sempre particolare, ma l’ umano . Solo l’affermazione di questa dimensione universale dell’esperienza può fondare il rispetto della singolarità dell’altro, di sua infinita alterità e differenza. L’umano si dice sempre in una cultura determinata. La struttura universale dell’esperienza è al tempo stesso in e al di là di ogni cultura, insieme trascendente e immanente, trans-immanente . Questa identità strutturale è costitutivamente assegnata a una emergenza molteplice. In questo contesto, si può parlare di una ragione che, in nome di una fedeltà all’esperienza, si dispone a ripensare il problema dell’universalità, il rapporto tra il singolare e l’universale. Como nenhuma cultura pode pretender uma validade universal, o processo de historicização da racionalidade ocidental marca o fim da pretensão metafísica de dizer a verdade do homem e do mundo, não obstante se acredite que fazer ciência já seja o acontecer da verdade. A necessidade do multiculturalismo reside no administrar a diversidade e no assegurar a tolerância. Sua fraqueza teórica se encontra paradoxalmente na incapacidade de pensar a própria diferença. Universal não é a cultura, que é sempre particular, mas o humano . Somente a afirmação desta dimensão universal da experiência pode fundar o respeito da singularidade do outro, de sua infinita alteridade e diferença. O humano se diz sempre numa cultura determinada. A estrutura universal da experiência está, ao mesmo tempo, em e além de cada cultura, ao mesmo tempo transcendente e imanente, trans-imanente . Esta identidade estrutural é constitutivamente assinalada a uma experiência múltipla. Nesse contexto, pode-se falar de uma razão que, em nome da fidelidada à experiência, dispõe-se a repensar o problema da universalidade, a relação entre o singular e o universal. As no culture can claim to universal validity, the historicizing process of western rationality points out the end of metaphysical pretension of telling the truth about man and the world, although one believe that doing science is already the case for truth. The necessity of multiculturalism lies in managing diversity and in ensuring tolerance. Its theoretical weakness is paradoxically unable to think of difference itself. Culture always emerges as being the particular as the human appears as being the universal. Only the statement of this universal dimension of experience can establish the respect of other's uniqueness, of his infinite otherness and difference. The human is always understood within a specific culture. The universal structure of experience is at the same time, in and beyond each culture in particular, at the same time immanent and transcendent, there is to say, trans-immanent. This structural identity is constitutively marked by a multiple experience. In this context, one can speak of a reason that in the name of fidelity to experience is willing to rethink the problem of universality, the relationship between the singular and universal. Il tema principale del saggio è un’interpretazione del metodo fenomenologico che, focalizzando la questione dell’identità, ne mette in evidenza il lato trascendentale ed egologico. L’obiettivo è il recupero dell’idea di filosofia come scienza rigorosa e il conseguente ritorno alla centralità del soggetto fenomenologico-trascendentale.Viene introdotto il concetto di circolo fenome-nologico, con il quale si intende indicare la ricorsività della riduzione e la necessità di restare in essa, per mantenere il livello fenomenologico dell’esperienza e della conoscenza. Si tratta di una circolarità virtuosa, (...) non solo perché è produttiva, ma anche perché procede attraverso una costante messa fra parentesi dei risultati e una continua riapertura degli orizzonti. Il circolo fenomenologico è un continuo campo di rimandi, caratteristico anche della correlazione noetico-noematica, tra l’io e il mondo, tra la libertà de-ll’atteggiamento e la verità dell’evidenza, un campo polarizzato i cui elementi si relazionano incessantemente e dal quale l’io esce con l’obiettivo però di farvi ritorno. L’io trascendentale dev’essere libero di compiere questo ritorno a se stesso, perché dentro di sé risiede la verità. Questa circolarità è dunque generatrice di libertà per quanto riguarda l’esercizio del metodo del “vedere fenomenologico”, e portatrice di verità per quanto riguarda l’esito del metodo stesso.Viene sottolineato come l’aspirazione fenomenologica a “vivere nella verità” sia uno sforzo per ricostituire quella verità fluente rappresentata dalla vita della soggettività nel terreno del mondo-della-vita. L’epoché, in quanto “totale rivolgimento esistenziale”, diventa il perno di uno stile di vita rivolto alla verità. Per la fenomenologia, vivere nella verità vuol dire vivere nella libertà, perché se la verità scaturisce dall’epoché, e se quest ’ultima si realizza come “sguardo veramente libero”, allora la verità non è solo legata alla libertà, ma ne è anche dipendente.Si sostiene qui che la soggettività fenomenologico-trascendentale rappresenta la chiave per una svolta rispetto alla situazione culturale attuale, nella quale il concetto di “io” è diventato uno dei principali bersagli critici. Viene mostrato come la soggettività sia collegata al metodo: infatti, annota Husserl in un manoscritto del 1924, “la soggettività è il mio tema, ed è un tema puro e in sé conchiuso, indipendente. Mos-trare che e come ciò sia possibile è il compito della descrizione del metodo della riduzione fenomenologica. Il “tema” di Husserl è dunque il suo compito filosofico e la sua missione esistenziale.Da qui si può interpretare anche la fenomenologia dell’intersoggettività sul piano storico-fattuale: la teoria fenomenologica dell’esperienza dell’estraneo non va confusa con i problemi della multiculturalità né tanto meno con le retoriche dell’alterità, ma è un’istanza che ripropone oggi l’antica questione della filosofia che si determina come ethos della theoria e quindi come “ragione pratica”, un’istanza che rimette al centro dell’attenzione quel fondamento che rischia di andare perduto nell’anonimato della tecnoscienza e nell’indistinto di una forma culturale globalizzata e globalizzante, un’istanza che richiama tutti noi a ritornare a ciò che Husserl chiamerebbe la costituzione originaria di senso della civiltà europea.El tema principal del paper es una interpretación del método fenomenológico que, enfocando la cuestión de la identidad, pone en evidencia su dimensión trascendental y egológica. El objetivo es el rescate de la idea husserliana de filosofía como ciencia rigurosa o estricta y el consiguiente regreso a la centralidad del sujeto fenomenológico-trascendental.Se introduce el concepto de círculo fenomenológico, que alude a la recursividad de la reducción y la necesidad de permanecer en ella, para mantener el nivel fenomenológico de la experiencia y del conocimiento. Se trata de una circularidad virtuosa, no sólo porque es productiva, sino porque avanza a través de una constante puesta entre paréntesis de los resultados y una continua reapertura de los horizontes. El círculo fenomenológico es un infinito campo de rebotes referenciales –propio en primer lugar de la correlación noético-noemática– entre el ego y el mundo, entre la libertad de la actitud y la verdad de la evidencia, un campo polarizado cuyas partes se relacionan incesantemente y del cual el ego sale pero con el objetivo de volver a entrar. El ego trascendental debe ser libre de cumplir este retorno a sí mismo, porque dentro de sí reside la verdad. Esta circularidad es entonces generadora de libertad por lo que se refiere al ejercicio del método del “mirar fenomenológico”, y portadora de verdad por lo que se refiere al resultado del método mismo.Se subraya la aspiración fenomenológica a “vivir en la verdad” como esfuerzo que se propone reconstruir esa verdad fluyente constituida por la vida de la subjetividad en el terreno del mundo de la vida. La epoché, en tanto “total transformación existencial”, se vuelve el perno de un estilo de vida orientado hacia a la verdad. Para la fenomenología, vivir en la verdad quiere decir vivir en la libertad, porque si la verdad surge de la epoché, y si esta última se realiza como “mirada verdaderamente libre”, entonces la verdad no está sólo ligada a la libertad, sino que resulta dependiente de ella.Se sostiene que la subjetividad fenomenológico-trascendental representa la clave para un viraje respecto de la situación cultural que prevalece en la actualidad, en la cual el concepto de “yo” se ha vuelto uno de los principales blancos de crítica. Se muestra aquí la radicalidad del nexo entre la subjetividad y el método. En un manuscrito de 1924 Husserl efectivamente anota: “la subjetividad es mi tema, y es un tema puro y en sí completo, independiente. Mostrar que ello es posible y de qué manera, es el cometido de la descripción del método de la reducción fenomenológica”. El “tema” de Husserl es por lo tanto su cometido filosófico y su misión existencial.A partir de aquí es posible interpretar también la fenomenología de la intersubjetividad a nivel histórico-fáctico: la teoría fenomenológica de la experiencia del extraño no debe ser confundida con los problemas de la multiculturalidad ni, menos aún, con las retóricas de la alteridad, sino que es una instancia que vuelve nuevamente actual la antigua cuestión de la filosofía que se determina como ethos de la theoria y por ende como “razón práctica”, una instancia que vuelve a poner al centro de nuestra atención ese fundamento que corría el riesgo de perderse en el anonimato de la tecnociencia y en lo indistinto de una forma cultural globalizada y globalizante, una instancia que reclama un retorno, de parte de todos nosotros, a lo que Husserl llamaría la constitu-ción originaria de sentido de la civilización europea. OBJECTIVES: To review the characteristics and performance of research ethics committees in Spain in the evaluation of multicentre clinical trial drug protocols. DESIGN: A prospective study of 100 applications. SETTING: Forty-one committees reviewing clinical trial protocols, involving 50 hospitals in 25 cities. MAIN MEASURES: Protocol-related features, characteristics of research ethics committees and evaluation dynamics. RESULTS: The 100 applications involved 15 protocols (of which 12 were multinational) with 12 drugs. Committees met monthly (except one). They had a mean number of 12 (...) members, requested a mean of six complete dossiers and nine additional copies of the protocol with a mean deadline of 14 days before the meeting. All applications were approved except three (two of the three were open-label long-term safety trials rejected by the same committee), which were approved by the other committees involved. The mean time from submission to approval was 64 days. The mean time from submission to arrival of the approval document at our offices was 85 days. Twenty-five committees raised queries for 38 of the 97 finally approved applications. Impact of evaluation fee, number of members, queries raised and experience of committees on timings were not statistically significant. CONCLUSION: Obtaining ethical approval is time-consuming. There is much diversity in the research ethics committees' performance. A remarkable delay (> 20 days) exists between the decision and the arrival of the written approval, suggesting administrative or organisational problems. (shrink)

Objectives: To review the performance of research ethics committees in Spain in assessing multicentre clinical trial drug protocols, and to evaluate if they would comply with the requirements of the new EU Directive to be implemented by May 2004.Design and setting: Prospective study of applications of MCT submitted to RECs.Main measurements: Protocol related features and evaluation process dynamics.Results: 187 applications to be performed in 114 centres, were reviewed by 62 RECs. RECs had a median number of 14 members, of which (...) three were lay members. All applications were approved except four which were however approved by the other RECs involved. The median times from submission to approval and from submission to reception at the sponsor’s offices were 48 and 62 days, respectively. In 55% of all applications approved, 41 RECs raised 307 queries, 40% of these were protocol related issues, and 38% related to the patients’ information sheets. RECs charging an evaluation fee in advance and applications with no queries raised were statistically significantly associated with shorter evaluation times. However, there is a gap of at least 1.5 weeks between the date of the meeting and the reception of the approval letter in the sponsor’s office.Conclusions: Evaluating MCT protocols by RECs is a time consuming process. Needing 1.5 weeks for communicating the decision taken by RECs to the sponsor suggests serious administrative shortcomings within most RECs. By significantly reducing the time for communication of their decisions, the majority of RECs would comply with the Directive requirement of a maximum 60 day period for the assessment of MCT. The paper investigates the distinctly Chinese intertwining of expertise and state & financial capital to enrich the current understanding of neoliberalism as a hegemonic governing rationale. Since the summer of 2015, China has been experiencing one of its most severe financial crises since the adoption of a ‘socialist market economy’ in 1978. However, globally circulating narratives have failed to look beyond a Western-centric corollary, rehashing a critique of the Chinese one-party system and its lack of a ‘genuine’ free market. By (...) exploring the specific genealogy of Chinese capitalism, and the distinctive Chinese financial-market structure, the article will show how the scientific authority of experts formulated amongst neoliberal thinkers never permeated the Chinese idea of knowledge. In the Chinese variety of financial capitalism, expertise is seen to lie not so much in the wisdom of individual experts as in their socio-political support, which legitimises their economic interventions. Il programma di ricerca filosofica di Maurizio Ferraris può essere ricapitolato, come egli ha scritto, in tre fasi in cui ha proposto: una estetica come teoria della sensibilità, una ontologia naturale come teoria dell’inemendabilità e una ontologia sociale come teoria della documentalità (cfr. Ferraris 2012a: x-xi). Tra queste, è stata soprattutto la prima fase del suo pensiero a influenzare i miei studi. In essa sono presenti talune delle principali tesi della sua filosofia positiva che, a mio modo di vedere, possono (...) essere sviluppate anche nell’ambito delle ricerche sulle arti contemporanee. Al fine di mostrare questa possibilità, il testo è organizzato come segue. Nei primi due paragrafi mi soffermo sulla concezione dell’estetica come teoria della sensibilità e su alcuni dei principali nuclei teorici della sua filosofia positiva. I tre successivi mirano a portare in primo piano alcune questioni concernenti la delicata relazione tra estetica e arte, e ad affrontarle tenendo conto sia della natura della prima sia delle incessanti evoluzioni della seconda. I due conclusivi offrono i lineamenti della proposta che penso possa essere formulata mantenendo come riferimento due insegnamenti tratti dalla filosofia positiva di Ferraris. (shrink)

A reciprocal symmetry between art and culture, the reductionism and the impoverishment of the artistic practices are all consequences of the establishment of the new conceptualist paradigm in art since the 60s. Nespolo’s artistic production in that period exemplifies this features being thus conceivable as a variant of conceptualism since he adopts its new experimental rules mixing them with the traditional ones of the visual artistic paradigm.

In response to the COVID-19 pandemic, large-scale research and pharmaceutical regulatory processes have proceeded at a dramatically increased pace with new and effective, evidence-based COVID-19 interventions rapidly making their way into the clinic. However, the swift generation of high-quality evidence and the efficient processing of regulatory authorisation have given rise to more specific and complex versions of well-known research ethics issues. In this paper, we identify three such issues by focusing on the authorisation of Molnupiravir, a novel antiviral medicine aimed (...) at reducing the ability of SARS-CoV-2 to multiply in the body, for clinical use by the National Health Service in England and the concomitant testing of Molnupiravir through the large-scale PANORAMIC randomised control trial. By analysing the ways in which the authorisation and clinical use of Molnupiravir complicate standard approaches to clinical equipoise, standard of care, and participant consent in the PANORAMIC randomised control trial we will explain some of ethical implications for clinical trials that aim to study the efficacy and safety of new COVID-19 and other therapeutics when conditional authorisation has already been granted and when such treatments have already been made available to patients by national health providers. The aim of this paper is to investigate among a group of non-profit organizations: a) the effect of ethical leadership on volunteers’ satisfaction, affective organizational commitment and intention to stay in the same organization; b) the role played by job satisfaction as a mediator in the relationship between ethical leadership and volunteers’ intentions to stay in the same organization, as well as between ethical leadership and affective commitment. An anonymous questionnaire was individually administered to 198 Italian volunteers of different non-profit (...) organizations. The questionnaire contained the Ethical Leadership Scale, the Volunteers Satisfaction Index, the Affective organization Scale, as well as questions regarding the participants’ age, sex, type of work, level of education, length of their volunteer works, intention to volunteer in the following months in the same organization. The construct as well the effects of EL on volunteers is approached in light of the Social Exchange Theory and the Social Learning Theory. Structural equation models were used to test hypothesized relationships. The results confirm the role of mediation of volunteer satisfaction in the relationships between the variables studied. In particular, ethical leadership was found to be positively associated both with volunteers’ intention of staying and with their affective commitment. In the first case this relationship is fully explained by the mediation of the volunteers’ satisfaction, while the latter is explained by both direct and indirect factors. To the authors’ knowledge, this the first attempt to understand the role played by ethical leadership on volunteers’ behavior and, more in general, in the management of non-profit organizations. Findings are relevant both for practitioners and managers of non-profit organization, since they suggest the relevance of the perception of ethical leadership by volunteers, as well as for scholars, since they further deepen the knowledge on EL and its effects on the followers. Limits of the study: the questionnaire was administered only among a group of non-statistical sample of volunteers. Furthermore, the study reached only volunteers from Italian non-profit organization. (shrink)

Everyday life practices are one of the focuses of interest for so-called 'sustainable transitions'. Efforts in making daily life more ecological have ranged from awareness-raising and behaviour change strategies to socio-technical innovations, but have produced limited results so far. In a present characterised by a prolonged and multifaceted crisis it is imperative that, as social scientists, we interrogate the (un)sustainability of everyday practices from a more critical angle, linking them to reflections about capitalism's ecological destructiveness. One fruitful way of doing (...) so is to interrogate the dimension of subjectivity as a space where collective discourses, practices and desires are embodied in concrete experience and actions. Drawing on ethnographic material on everyday energy use, I suggest that contemporary ways of living certainly contribute to the overall reproduction of capitalism and yet, in the (dis)juncture of the crisis, more sustainable livelihoods can be experimented with and prefigured. Subjectivity is one crucial dimension in which this process unravels. (shrink)

By analysing the ways in which the authorisation and clinical use of molnupiravir complicate standard approaches to clinical equipoise, standard of care and participant consent in the PANORAMIC randomised control trial, we will explain some of ethical implications for clinical trials that aim to study the efficacy and safety of new COVID-19 and other therapeutics when conditional authorisation has already been granted and when such treatments have already been made available to patients by national health providers. We argue against the claim that the employment of diagrams in Euclidean geometry gives rise to gaps in the proofs. First, we argue that it is a mistake to evaluate its merits through the lenses of Hilbert’s formal reconstruction. Second, we elucidate the abilities employed in diagram-based inferences in the Elements and show that diagrams are mathematically reputable tools. Finally, we complement our analysis with a review of recent experimental results purporting to show that, not only is the Euclidean diagram-based (...) practice strictly regimented, it is rooted in cognitive abilities that are universally shared. In recent years, companies receive pressure to release environmental, social, and governance disclosure, since these are perceived as critical issues by society. Despite this pressure, ESG disclosure practices considerably vary by firm. Prior academic literature investigated country- and firm-level factors determining such variation, alternatively adopting the institutional and legitimacy theory. By combining these theories in a unique framework, this study investigates the extent to which social structures and social legitimization influence ESG disclosure practices and each pillar. Results obtained using a (...) cross-country sample of 14,174 firm-year observations during 2005–2012 provide evidence that country-level characteristics such as a political system, labor system, and cultural system significantly affect firms’ ESG disclosure practices. However, their impact is heterogeneous in that they either reduce or enhance disclosure levels and may differ by pillar. Results for firm-level characteristics related to a firm’s visibility demonstrate a positive and homogeneous effect on ESG disclosure and each pillar. These results inform policy makers and regulators aiming to enhance ESG disclosure levels of the risk they incur when managing variables related to social structure and the benefits of exposing firms to higher visibility.
